A-Ballet School Policy (School Rules)

1. About A-Ballet School

A-Ballet School provides ballet and dance education for children and adults in a safe, respectful and inspiring environment.

Our aim is to support technical and artistic development, discipline, confidence, creativity and enjoyment of movement.

A-Ballet School operates under the A-Ballet brand.

All A-Ballet School services purchased directly through www.worldaballet.com are provided and invoiced by:

Classes may be taught by Aliya Tanykpayeva or by other authorised A-Ballet School instructors working with the School.

These School Rules form part of the conditions applicable to A-Ballet School services together with the Terms & Conditions and Privacy Policy.

2. Enrollment and Registration

The general minimum age for children's classes is 4 years unless a specific programme states otherwise.

A Trial Lesson is recommended for new students and may be requested where level placement is necessary.

Registration and booking must be completed before participation.

For participants under 18, registration and acceptance of the applicable terms must be completed by a parent, legal guardian or other person legally authorised to act for the minor.

Class placement is determined according to factors including:

age;
previous experience;
technical level;
physical and developmental readiness;
instructor assessment;
available class capacity.

The School may recommend a different group where this is considered more appropriate for the student's development or safety.

Advance booking is required.

Where a class is full, a waiting list may apply.

3. Tuition, Packages and Payment

Payment is generally required in advance unless expressly agreed otherwise.

Available payment options may include:

Trial Lessons;
Single Lessons;
class packages;
subscriptions;
private lessons;
online lessons;
workshops or intensives.

The price, validity period and applicable conditions of each service or plan are displayed before purchase.

A package or subscription may only be used during its stated validity period.

Unused sessions normally expire at the end of the applicable validity period unless otherwise stated for the particular plan or required by law.

Payments made for A-Ballet School services through www.worldaballet.com are received and invoiced by Aliya Tanykpayeva e.v.

School services sold through this website are available to private individuals only.

Company purchases and invoices issued to companies or other organisations are not available through the regular A-Ballet School checkout.

Non-payment of an amount that has become due may result in suspension of further participation until the outstanding amount is resolved.

4. Annual School Performance & Costume Fee

Participation in A-Ballet School performances is optional.

Regular child students who choose to participate in A-Ballet School performances are required to pay an Annual School Performance & Costume Fee once per school year.

The applicable amount is communicated before the student confirms participation and may be displayed in the relevant children's class, plan or performance information.

The fee contributes to shared School and production expenses, which may include:

costumes and costume materials;
costume rental, alteration, maintenance and cleaning;
props and production materials;
rehearsal preparation;
performance organisation and administration;
technical and venue-related School performance expenses;
other reasonable shared expenses connected with student performances.

A child who first joins A-Ballet School during the second half of the School year, from 1 February, and chooses to participate in School performances pays 50% of the applicable annual fee.

The reduced fee is determined by the date the student first joins the School.

Payment of the fee does not transfer ownership of School costumes, props or production materials to the student unless expressly stated otherwise.

Payment of the fee also does not guarantee a particular role, casting or participation in every performance.

Exceptional individual costs, such as travel, accommodation, external competitions, examinations or special items not included in the annual fee, may be charged separately where applicable. Such costs will be communicated in advance.

Where a student withdraws from a confirmed performance after costume, production or organisational costs have already been reasonably incurred or committed, the corresponding part of the fee may be non-refundable to the extent permitted by applicable law.

If A-Ballet School cancels the student's participation for reasons unrelated to the student's conduct, attendance or preparation, any appropriate refund or credit will be considered taking into account costs already reasonably incurred.

5. Cancellations and No-Shows

A booked class should be cancelled or rescheduled at least 24 hours before the scheduled start time.

Where cancellation is made at least 24 hours in advance, rescheduling or class credit may be available according to the conditions of the relevant booking or plan.

A cancellation made less than 24 hours before the class or failure to attend is normally treated as a used session and does not automatically entitle the participant to a refund, replacement class or credit.

Exceptional circumstances such as serious illness, injury or family emergency may be considered individually where reasonably possible.

If A-Ballet School cancels a class, the School will normally provide an alternative class, rescheduling or credit.

Where an appropriate replacement cannot reasonably be provided, any refund required under the applicable service conditions or mandatory law will be provided.

6. Online Classes

Online classes are conducted live through Zoom or another platform designated by A-Ballet School.

Participants are responsible for having:

a suitable device;
adequate internet access;
appropriate software or applications;
sufficient space;
suitable flooring and a safe training environment.

Participants should test their access to the relevant platform before the scheduled start time.

Problems arising from the participant's internet connection, device, software, account, email access or other participant-side technical circumstances do not automatically create a right to refund, credit or rescheduling.

Online classes may be cancelled at least 24 hours in advance in accordance with the normal cancellation rules.

If a participant misses an online class, access to a recording may be provided where a suitable recording is available. Provision of a recording is not guaranteed unless expressly included in the relevant service.

If technical problems attributable to A-Ballet School prevent the class from being delivered, the School may provide an alternative class, rescheduling, credit, recording or, where appropriate, a refund.

A-Ballet School may reasonably change the online platform, instructor, timetable or technical format where necessary.

An online class may be recorded only where participants have been appropriately informed and the recording is permitted under the applicable privacy and media rules.

Where reasonably practicable, recordings made for replay should avoid unnecessary inclusion of identifiable participants unless the appropriate permission or other lawful basis applies.

Recordings provided to participants are strictly for personal educational use.

They may not be copied, shared, published, uploaded, sold, streamed or distributed without prior permission.

7. Attendance and Punctuality

Students should arrive approximately 10 minutes before class so they have sufficient time to prepare.

Regular attendance is important for technical progress, physical preparation and performance participation.

Students arriving late may be asked to wait before joining or may have their participation limited where the instructor considers immediate participation unsafe.

Repeated absence may affect class placement or participation in performances.

8. Conduct and Discipline

Students, parents and visitors must treat instructors, staff, other students and other participants respectfully.

The following behaviour is not acceptable:

aggressive or threatening behaviour;
harassment or bullying;
discriminatory behaviour;
intentional disruption of teaching;
repeated refusal to follow reasonable safety instructions;
behaviour that creates a risk to other participants.

Mobile phones must be switched off or silenced during class unless their use has been authorised.

A-Ballet School may issue a warning, temporarily suspend participation or terminate participation where this is reasonably necessary to protect students, staff, safety or the educational environment.

In serious cases, immediate removal may be necessary.

Any financial consequences of suspension or termination will be handled according to the circumstances, the applicable contractual conditions and mandatory consumer law.

9. Parents and Guardians

Parents and guardians are responsible for providing accurate contact information and remaining reachable where reasonably necessary during a child's participation.

Younger children must be brought to and collected from the School by a parent, guardian or authorised person.

Where appropriate for the child's age, independent arrival or departure may be permitted where the parent or guardian has agreed to this arrangement.

Parents and guardians are responsible for timely collection after class.

Access to the studio during lessons may be restricted so that students and instructors can work without unnecessary distraction.

Parents may attend or observe classes only where invited or permitted by the instructor.

Parents and guardians must follow reasonable School and venue instructions.

10. Dress Code and A-Ballet School Uniform

Appropriate ballet clothing and footwear must be worn during regular classes.

For a Trial Lesson, the official A-Ballet School uniform is not required.

A child attending a Trial Lesson may wear comfortable, fitted clothing suitable for movement and ballet shoes or suitable socks where appropriate.

After joining A-Ballet School as a regular child student, the student is expected to follow the official School dress code.

The official A-Ballet School uniform is available for purchase through the School.

A reasonable transition period may be allowed for a newly enrolled student to obtain the required uniform.

Adult students should wear comfortable, fitted clothing suitable for ballet and the level of the class.

Hair should be securely arranged where appropriate for ballet training.

Jewellery that may create a safety risk should not be worn. Small stud earrings may be permitted where safe.

Good personal hygiene is expected.

11. Health and Safety

Ballet and dance are physical activities and involve normal risks associated with exercise, movement, stretching, balance, jumping and physical training.

Participants, or parents and guardians in the case of minors, are responsible for considering whether participation is appropriate.

Where there is uncertainty about a medical condition, injury or physical limitation, appropriate medical advice should be obtained before participation.

A-Ballet School does not routinely require detailed medical histories or diagnoses.

However, participants or parents and guardians must inform the instructor of any known injury, physical limitation or restriction that is relevant to safe participation.

Only information reasonably necessary for safe participation should be provided.

Participants must:

follow reasonable safety instructions;
participate at an appropriate level;
stop exercising and inform the instructor if they experience pain, dizziness, unusual weakness or other significant discomfort;
avoid attending class where they have a contagious illness that may put others at risk.

An instructor may modify, restrict or stop an exercise or a participant's involvement where reasonably considered necessary for safety.

A-Ballet School cannot reasonably adapt training to a relevant limitation or restriction of which the instructor has not been informed.

Where an emergency occurs, the School may take reasonable steps to obtain appropriate assistance and contact the participant's emergency contact, parent or guardian.

During rehearsals, performances, travel or activities at third-party venues, risks may also arise from circumstances outside the School's direct control.

Nothing in these School Rules excludes or limits liability for death, personal injury, damage to health or any other liability to the extent that such liability cannot lawfully be excluded or limited.

12. Online Participation Safety

Participants joining online classes are responsible for ensuring that the area in which they train is suitable and reasonably safe for physical activity.

The training area should have sufficient space and an appropriate floor and should be free from obstacles or hazards.

Where appropriate because of the participant's age or circumstances, parental or adult supervision should be available.

Participants should not perform an exercise if they believe their environment or physical condition makes the exercise unsafe.

A-Ballet School cannot control the participant's home environment, equipment, flooring or internet connection.

Nothing in this section excludes liability that cannot lawfully be excluded.

13. Property and Facilities

Students must respect School facilities, equipment, costumes, props and other property.

Intentional damage or damage caused through negligence may be charged to the person responsible, or to the parent or guardian where legally appropriate.

School costumes and props remain School or production property unless they are expressly sold to the participant.

Items must be returned when requested and in reasonable condition, allowing for ordinary wear from proper use.

Participants should avoid bringing unnecessary valuables to classes.

To the extent permitted by law, the School is not responsible for personal items that are lost, stolen or damaged where the loss is not attributable to the School.

14. Performances, Rehearsals and Events

Participation in A-Ballet School performances is voluntary unless a particular programme expressly includes performance participation as part of the service.

Participation may depend on:

age;
technical level;
regular attendance;
preparation;
rehearsal availability;
casting requirements;
artistic considerations;
safety.

Roles and casting are determined by the artistic team.

Payment of classes or the Annual School Performance & Costume Fee does not guarantee a specific role or appearance in every performance.

Once a student confirms participation in a production, regular attendance at required rehearsals is expected.

Students who repeatedly miss important rehearsals, are insufficiently prepared or do not follow reasonable production or safety instructions may have their role changed or may be removed from the performance.

The artistic team may also make reasonable changes to casting, choreography, rehearsal arrangements or production plans where necessary.

Additional costs relating to travel, accommodation, competitions, external examinations or other special activities may apply and will be communicated in advance.

Specific performances may also have separate participation conditions.

Where professional photography or video recording is an integral part of a production, a separate Performance Participation & Media Agreement may be required before participation is confirmed.

The organiser, ticket seller and applicable ticket conditions for a particular performance may be identified separately from the School service.

15. Photography, Video and Media Consent

Photographs and video recordings may be created during classes, rehearsals, School activities, performances and events.

Participation in ordinary A-Ballet School classes does not automatically constitute consent to promotional use of an identifiable student's photograph or video.

Where consent is the appropriate legal basis for promotional or advertising use, A-Ballet will request separate media permission.

For an adult student, permission is provided by the student.

For a student under 18, permission is provided by the parent or legal guardian.

Media permission may be collected electronically and may normally be requested once for the relevant School year.

Giving promotional media consent is voluntary and is not a condition of attending regular A-Ballet School classes.

Media consent may be withdrawn for future consent-based use in accordance with the Privacy Policy.

Withdrawal does not affect processing that was lawful before the withdrawal.

General crowd or audience recordings may be created and used where permitted by applicable law.

For a specific optional performance or professionally recorded production, separate media conditions may apply where recording is an integral part of that production.

A student who does not accept the media requirements of a particular optional recorded production may continue attending regular School classes but may be unable to participate in that specific production.

Students, parents and visitors may not record, publish or distribute identifiable images or recordings of other students without appropriate permission.

Professional or commercial filming, livestreaming or recording of A-Ballet classes, rehearsals or performances requires prior permission.

16. Intellectual Property

Original A-Ballet materials and content remain the property of A-Ballet and/or their respective creators or rights holders.

This may include, where legally protected:

original choreography;
educational materials;
class recordings;
videos and photographs;
graphic materials;
music edits;
written training resources;
other original creative content.

Such materials may not be copied, reproduced, distributed, published, sold, uploaded, streamed, taught commercially or otherwise commercially exploited without the permission of the relevant rights holder.

This provision does not claim ownership over general ballet technique, public-domain material or third-party intellectual property.

17. Changes, Cancellations and Circumstances Beyond Reasonable Control

A-Ballet School may need to change, relocate, postpone or cancel a class or activity because of circumstances outside its reasonable control.

Such circumstances may include:

severe weather;
government or authority measures;
public emergencies;
building or venue closure;
utility or infrastructure failure;
serious technical disruption;
other comparable exceptional circumstances.

Where reasonably possible, the School may offer an alternative date, location, class or online option.

Any credit or refund will be handled according to the relevant service conditions and mandatory consumer law.

18. Changes to These School Rules

These School Rules may be updated where School operations, services or legal requirements change.

The current version and effective date will be published on the official website.

Updates generally apply prospectively.

A change will not retroactively remove rights already acquired under an existing booking or contract unless this is permitted or required by applicable law.

Where a material change directly affects an existing service or booking, affected participants will be informed where appropriate.
