Tickets, Shop & Refund Policy – A-Ballet

1. Scope of This Policy
This Policy applies only where Aliya Art Kft. is identified as the organiser, seller or invoicing party for an A-Ballet performance, ticket or product.

A-Ballet tickets and products may be offered through a separate A-Ballet website, sub-site, venue or authorised ticketing platform.
The applicable organiser and seller will be identified before purchase.
This Policy does not apply to A-Ballet School lessons purchased from Aliya Tanykpayeva e.v. through the regular School booking system.
If a particular School performance is organised or sold by another identified provider, including Dmitry Timofeev e.v., the seller and applicable terms displayed for that specific event apply.
2. Ticket Sales
Tickets are valid only for the performance, date, time and seating category stated on the ticket or booking confirmation.
Tickets may be sold:

directly by Aliya Art Kft.;
-
through an authorised venue;
-
through an authorised ticketing platform;
-
through another specifically identified event seller.
Where tickets are purchased through a third-party ticketing platform or venue, the terms, payment conditions, service fees and refund procedures of that seller may also apply.
Electronic tickets may normally be presented digitally or in printed form unless otherwise stated.
The organiser or venue may verify ticket validity where reasonably necessary.
A duplicated, invalid, cancelled or fraudulently obtained ticket may be refused.
3. Ticket Refunds and Exchanges
Tickets for performances scheduled for a specific date or period are generally not subject to the statutory 14-day consumer withdrawal right applicable to ordinary online purchases.
Unless otherwise stated for the particular event, tickets are therefore generally non-refundable and non-exchangeable when the customer simply changes their plans or is unable to attend.
This does not limit rights arising where the organiser fails to provide the purchased event or where mandatory consumer law provides otherwise.
Event Cancellation
If an event is cancelled and no replacement performance is accepted by the customer, the ticket price paid to Aliya Art Kft. will be refunded as required by applicable law.
Any fees charged separately by an external ticketing platform are subject to the applicable platform terms and mandatory law.
Event Rescheduling
If an event is materially rescheduled to another date or time, affected ticket holders will be informed and an appropriate replacement, exchange or refund option will be provided where required by applicable law or the applicable event conditions.
Programme and Cast Changes
Performers, casting, repertoire, programme order, choreography, production elements and other artistic details may change where reasonably necessary.
A change that does not materially alter the essential nature of the event does not normally create a right to a refund.
4. Entry and Audience Conduct
Visitors must comply with reasonable venue and organiser rules.
Latecomers may be admitted only at a suitable break or at another time determined by the venue.
Where allocated seating applies, visitors should occupy the seat indicated on their ticket unless instructed otherwise.
The organiser or venue may refuse entry or require a visitor to leave where reasonably necessary because of:

threatening, abusive or seriously disruptive behaviour;

safety concerns;
-
intoxication creating a safety or behavioural risk;
-
violation of applicable law;
-
serious violation of venue rules;
-
use of an invalid or fraudulent ticket.
Where refusal or removal results from the visitor's own serious misconduct or breach of applicable conditions, a refund may not be provided to the extent permitted by law.
5. Photography, Video and Recording at Events
A-Ballet performances and events may be professionally photographed, filmed or otherwise recorded.
General audience, atmosphere and crowd recordings may be created and used where permitted by applicable law.
Attendance at an event does not by itself constitute blanket consent to unrestricted promotional use of an identifiable close-up image of an individual.
Where individual consent is legally required for identifiable promotional use, the appropriate permission will be obtained or another applicable lawful basis must exist.
Notices regarding professional recording may also be displayed at the venue.
The organiser reserves the rights relating to its authorised professional photography, video, livestream, broadcast and other event recordings.
Visitors may not make professional, commercial or unauthorised livestream recordings of performances.
Personal photography or recording may also be restricted or prohibited according to the rules of the particular event or venue.
6. Shop and Merchandise
Where A-Ballet merchandise is offered by Aliya Art Kft., the product description, price and available collection or delivery method will be shown before purchase.
Products may include pre-order items.
Unless delivery is specifically offered, online orders must be collected from the location communicated during checkout or in the order confirmation.
Availability may be limited.
Consumer prices include applicable VAT unless lawfully indicated otherwise.
Minor differences in colour or appearance may occur between product images displayed on a screen and the physical item.
7. Consumer Right of Withdrawal for Products
For eligible products purchased online, consumers generally have a statutory right to withdraw from the purchase within 14 days without giving a reason.
The withdrawal period normally begins on the day the consumer, or a third party designated by the consumer other than the carrier, receives the product.
The consumer may also communicate the decision to withdraw before collecting or receiving the product.
To exercise the right of withdrawal, the consumer must send a clear statement to:
After notifying us of withdrawal, the product must be returned or handed back without undue delay and no later than 14 days after the withdrawal was communicated.
The consumer bears the direct cost of returning the product unless Aliya Art Kft. expressly agrees otherwise.
Refunds will be made within the period required by applicable law. Where permitted, reimbursement may be withheld until the product has been returned or the consumer provides evidence that it has been sent back.
Refunds will normally be made using the original payment method unless otherwise agreed.
8. Exceptions to the Product Withdrawal Right
The statutory withdrawal right may not apply in cases provided by law, including in particular:

products made to the consumer's specifications;

clearly personalised products;
-
products liable to deteriorate or expire rapidly;
-
sealed products that are not suitable for return for health protection or hygiene reasons once the seal has been opened;

other products specifically excluded from the withdrawal right by applicable law.
Simply opening packaging or trying a normal product does not automatically remove the statutory withdrawal right unless a legal exception applies.
However, the consumer may be responsible for any reduction in value resulting from handling the product beyond what is necessary to establish its nature, characteristics and functioning.
9. Defective or Non-Conforming Products
The statutory right of withdrawal is separate from the consumer's legal rights relating to defective or non-conforming products.

Nothing in this Policy limits statutory warranty, conformity, repair, replacement, price reduction, refund or other consumer rights that apply under Hungarian or European Union law.

11. Circumstances Beyond Reasonable Control
An event may need to be postponed, relocated, modified or cancelled because of circumstances beyond the organiser's reasonable control.
Where possible, ticket holders will be informed and reasonable alternative arrangements will be offered.
Force majeure or similar circumstances do not remove consumer rights that cannot lawfully be excluded.
12. Liability
Aliya Art Kft. is responsible in accordance with applicable Hungarian and European Union law.
To the extent permitted by law, Aliya Art Kft. is not responsible for indirect losses that could not reasonably have been foreseen or that were not caused by a breach attributable to Aliya Art Kft.
Nothing in this Policy excludes or limits liability or consumer rights that cannot legally be excluded or limited.
13. Complaints
Questions or written complaints regarding tickets or products sold by Aliya Art Kft. may be submitted to:

Written consumer complaints will be answered within the period required by Hungarian law.
Consumers may also use the applicable Hungarian consumer conciliation procedure where a dispute cannot be resolved directly.
14. Changes to This Policy
This Policy may be updated if ticketing arrangements, shop services, payment systems or legal requirements change.
The version applicable to a purchase is the version made available in connection with that purchase, subject to mandatory law.
